What happens if one or both are sued but settle with the plaintiffs before any judicial finding of liability (or admission thereof)? In other words, they “pay damages” per the lead question but technically are not “found liable” as seems to be required per the “Market Information” section.

The question now being asked about the credit rating agencies is whether or not they will be found liable for investor losses in mortgage backed securities. This is an attempt to handicap that probability.
